Terms of service

The agreement between Travagon and the agencies that use it.

1.These terms

These terms are a contract between [Company legal name], a company registered in [England and Wales] under company number [company number], whose registered office is at [registered office address] (“we”, “us”) and the business that signs up for Travagon (“you”, the “agency”). By creating an account or using Travagon, you agree to them on behalf of your business. If you don’t have authority to do that, please don’t use Travagon.

Travagon is for businesses only. You are not a consumer when you use it, and these terms are written on that basis. Our data processing addendum forms part of these terms.

2.Your account

  • You must give accurate details, keep them up to date, and be at least 18.
  • You are responsible for everyone you invite to your account, for what they do in it, and for choosing what each person can see.
  • Keep sign-in details secure. Account owners must use two-factor authentication. Tell us straight away if you think your account has been misused.

3.Subscription and payment

  • Fees are charged per agent (each person with access to your account) per month, at the prices on our pricing page when you subscribe, plus VAT.
  • You choose monthly or annual billing. Fees are paid in advance for each billing period and renew automatically until you cancel.
  • If you add agents part-way through a period, we charge for them from when they are added. Removing agents takes effect from your next billing period.
  • We may change our prices by giving you at least 30 days' notice. The new price applies from your next billing period after the notice ends; annual plans keep their price until renewal.
  • Fees already paid are not refunded for part periods, except where the law requires it.
  • If a payment fails and isn't fixed within 14 days of our reminder, we may suspend your account until it is.

4.Your data

The data you and your team put into Travagon, such as customer records, bookings, messages and documents, belongs to you. You give us permission to host and process it only to provide and support the service. You are the controller of personal data in it, and we process it as your processor under the data processing addendum.

You can export your data at any time. You are responsible for having a lawful basis to collect and store it, and for telling your customers how you use their data.

5.Your regulatory responsibilities

Travagon is a tool that helps you run your agency. It does not make you compliant with the rules that apply to your business, and it is not legal, tax or regulatory advice. In particular, you remain responsible for:

  • holding any licences and protection you need, such as an ATOL or ABTA membership, and following their terms
  • the content and timely issue of ATOL certificates, invoices and other documents you produce with Travagon, and checking them before you send them
  • complying with the Package Travel and Linked Travel Arrangements Regulations, consumer law and the rules on card surcharges
  • using WhatsApp, Instagram, Messenger and other channels within those platforms' own terms and messaging rules
  • ticketing before airline deadlines: Travagon's reminders are an aid, not a guarantee

6.Services you connect

Some features work by connecting your own accounts with other providers, such as Stripe for payments and Meta for WhatsApp, Instagram and Messenger. Your use of those services is governed by your agreement with them; for payments, you are the merchant on your own Stripe account. We are not responsible for those services, their fees or their availability, but we will do our best to keep Travagon’s connections to them working.

7.Acceptable use

You must not use Travagon to:

  • break the law, or help anyone else to
  • send spam, or marketing messages to people who haven't agreed to receive them
  • upload anything malicious, or try to get into accounts or data that aren't yours
  • probe, overload or reverse-engineer the service, or copy it to build a competing product
  • resell or share access to Travagon outside your agency without our written agreement

We may suspend access that breaks these rules, telling you why unless the law or the risk prevents it.

8.The service

  • We will provide Travagon with reasonable care and skill, and work to keep it available and secure. We don't promise it will be uninterrupted or free of errors, and we may need short maintenance windows.
  • We improve Travagon all the time and may change or remove features. If a change significantly reduces what you pay for, we will tell you in advance and you may cancel.
  • Support is by email at [contact email].
  • Travagon and everything in it apart from your data, including the software, design and brand, belong to us or our licensors. Your subscription gives you a right to use it, not ownership of it.

9.Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited.

Subject to that:

  • neither of us is liable for loss of profits, revenue, business, goodwill or anticipated savings, or for any indirect or consequential loss
  • our total liability to you under or in connection with these terms in any 12 months is limited to the fees you paid us in those 12 months

10.Cancelling and ending

  • You can cancel at any time by emailing us. Your subscription ends at the end of the billing period you have paid for.
  • We may end these terms with 30 days' notice, or straight away if you seriously breach them and don't put it right within 14 days of our asking.
  • After your subscription ends you have 30 days to export your data. We then delete it from our live systems, and from backups as they are overwritten.

11.General

  • We may update these terms. We will give you at least 30 days' notice of changes that matter to you by email; if you don't agree, you can cancel before they take effect.
  • Neither of us is responsible for delays caused by events outside our reasonable control.
  • If any part of these terms is found unenforceable, the rest still applies. These terms are the whole agreement between us about Travagon.
  • These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. Notices to us go to [contact email] or our registered office at [registered office address].
